2010.03.05 | Lukashenko sets rules for charging lease fees for state-owned land plots

Annual lease rates will be based on the cadastral value of land using indexes depending on the type and designation of land. The indexes are set equal to the indexes stipulated in the Tax Code for land tax computation.

Annual lease fees for land plots in state ownership will thus be equal to land tax rates, the press service said.

The ordinance preserves preferential lease rates for certain types of land plots, especially historical and cultural areas, contaminated zones and areas for national reserves and parks.

The document has it that land fees will be charged as from the first day of the month following the month when local administrations or administrations of free economic zones take a decision on allocation of land and registration of lease title.

Land tax will be paid starting from the first day of the month that follows the month when the decision on land allocation is taken.

Under the Tax Code (that does not regulate land lease fees for state-owned plots – Prime-Tass), land taxes charged based on the cadastral value of land, its type and designation, not the size of the plot, as from January 1, 2010.

The ordinance comes into effect as from the day it is signed and will be applied to all land relations starting January 1, 2010.
